Interpretation

Service refers to the Website or the governing lease.
Tenant the person or company who occupies the land or property rented from the landlord.
Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service and are found in the governing signed lease.

You means the Tenant or the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

The governing lease contains All Terms and Conditions in agreement between Landlord and Tenant and many not be changed except by written agreement.

The governing lease is binding upon and inures to the benefit of the parties and their respective heirs, executors, administrators, successors, and permitted assigns.

All Tenants are jointly and severally liable for all provisions of the signed lease. Any act or notice to, or refund to, or signature of, any one or more of the Tenants regarding any term of this lease, its renewal, or its termination is binding on all Tenants.

Landlord's delay, waiver, or non-enforcement of acceleration, contractual or statutory lien, rental due date, or any other right will not be deemed a waiver of any other or subsequent breach by Tenant or any other term in this lease.

Provided that Tenant is not in default of this lease, Landlord covenants that Tenant will enjoy possession and use of the leased premises free from material interference.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You sign a lease or use the Website and tells You about Your privacy rights and how the law protects You. Governing Law
The laws of the State of Texas govern the interpretation, performance, and enforcement of the lease.

Limitation of Liability
All liability of Landlord to Tenant for any default by Landlord under the terms of the Lease shall be limited to the proceeds of sale on execution of the interest of Landlord in the Property; it being stipulated and agreed that Landlord shall not be personally liable for any deficiency.
Landlord and Landlord's agents and employees shall not be liable for and Tenant hereby waives all claims for injury to persons or damage to property sustained by Tenant or any person claiming through Tenant resulting from any accident or occurrence in or upon the Leased Premises or in the Property, including, but not limited to, all claims for damage resulting from (i) any equipment or appurtenances falling into a state of disrepair, (ii) Landlord's failure to keep the Leased Premises or other part of the Property in repair, (iii) injury or damage done or occasioned by theft, wind, water, flooding, freezing, fire, act of God, explosion, earthquake, excessive heat or cold, vandalism, riot, or disorder, or other casualty, (iv) any defect in or failure of plumbing, heating or air-conditioning equipment, electric wiring or the installation thereof, gas, water, steam pipes, stairs, railings, or walks, (v) broken glass, the backing up of any sewer pipe or downspouts, the bursting, leaking or running of any tank tub, washstand, water closet, waste pipe, drain, or any other pipe or tank in, upon or about the Leased Premises or the Property in which the Leased Premises are located, the escape of steam or hot water, it being agreed that all of the same are under the control of Tenant, (vi) water, snow or ice being upon or coming through the roof, skylight, trapdoor, stairs, walks, or any other place upon or near the Leased Premises or otherwise, (vii) the falling of any fixture, plaster or stucco and (viii) any act, omission or negligence of other tenants or occupants of any premises in the Property or adjoining or contiguous buildings or owners of adjacent or contiguous property.

Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver
Landlord's delay, waiver, or non-enforcement of acceleration, contractual or statutory lien, rental due date, or any other right will not be deemed a waiver of any other or subsequent breach by Tenant or any other term in the governing lease.
